Quotes, Pricing, and Equipment Transactions

Website content, quote requests, trade-in tools, equipment evaluations, purchase inquiries, estimated timelines, financing examples, and displayed pricing do not constitute a binding offer or completed transaction.

Unless a written quote states otherwise, taxes, shipping, rigging, installation, construction, permitting, training, ancillary equipment, software, third-party services, and related expenses are additional. Quote validity periods and payment requirements are stated in the applicable written proposal.

We may correct pricing, specification, or availability errors and may refuse or cancel a transaction before completion for errors, suspected fraud, regulatory restrictions, nonpayment, or unavailability. If payment has been collected for a canceled transaction, the applicable written agreement and law govern any refund.

Transfer of title, risk of loss, delivery, inspection, acceptance, returns, restocking, late charges, and remedies for nonpayment are governed by the applicable written transaction documents.

A transaction becomes binding only when the required written documents are validly accepted and all stated deposits, approvals, and conditions are satisfied. If website content conflicts with a signed agreement, the signed agreement controls.

Refurbished and Pre-Owned Equipment

Refurbished and pre-owned equipment is not new. It may show normal cosmetic wear and may have age-related limitations, prior use, discontinued features, software limitations, limited parts availability, or manufacturer end-of-support conditions.

Website descriptions and sales materials provide a high-level description of the equipment. Unless expressly agreed in writing, Encompass does not undertake to provide a component-by-component repair history, replacement-parts history, or detailed refurbishment report.

The applicable proposal or agreement controls the specific unit offered, included components, price, and any written warranty. Buyers should review that information and raise any questions before completing a purchase.

Terms such as “professionally refurbished,” “inspected,” or “tested” describe Encompass’s general preparation or evaluation of the equipment. They do not mean that every component was replaced, that the equipment is manufacturer-certified or equivalent to new, or that any particular remaining useful life or future performance is guaranteed. Manufacturer warranties do not apply unless expressly confirmed in writing.

Installation, Site Planning, Training, and Support

Installation and related services may depend on site readiness, access, utilities, network connectivity, shielding, construction, permitting, regulatory approvals, shipping, scheduling, equipment condition, and third-party performance.

Customers are responsible for obligations assigned to them in the applicable agreement, including site preparation, construction, utilities, network requirements, access, permitting, compliance, and coordination with qualified independent professionals.

Training and support are limited to the scope, schedule, exclusions, and fees stated in the applicable written agreement. They do not replace professional education, clinical judgment, manufacturer instructions, licensing requirements, or legal and regulatory compliance.

Financing

Financing information is provided for general informational purposes. Financing may be offered through independent third-party providers and is subject to their approval, documentation, credit criteria, and separate terms.

Unless expressly agreed in writing, Encompass is not a lender, does not guarantee approval or specific terms, and has no obligation to hold equipment or pricing while financing is considered. Encompass is not responsible for a financing provider’s acts, omissions, or decisions.

Third-Party Websites, Products, and Services

The website may reference or link to manufacturers, financing companies, software providers, service organizations, shipping providers, or other third parties. Links are provided for convenience and do not necessarily constitute endorsement.

We do not control and are not responsible for third-party websites, products, software, security, availability, compatibility, privacy practices, content, or contractual terms. Separate third-party terms may apply. Combining equipment with unsupported third-party components may affect performance, support, or warranty coverage.

Website Disclaimer

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee uninterrupted, timely, secure, accurate, complete, error-free, or harmful-component-free website access. Information obtained from the website does not create a warranty unless expressly included in a signed writing.

Entire agreement. These Terms and the Privacy Policy constitute the agreement governing website use. Signed proposals, orders, warranties, and service agreements separately govern applicable transactions and control if they conflict with website content.

Governing Law and Severability
